Narrative

Green Co, KY - Order Book 8, page 3, Sept 1825: Benjamin DeSpain appointed overseer of the Lee's Ferry road at the fork of the creek at Hartwell Martin's to the mill.

Ben D Spain owed $0.33 in the settlement of John Burnet, guardian of James D. Allen 19 Mar 1832.

Benjamin Despain was a debtor to Porter & Akins Mertcantile for $12.25, 25 Sep 1833.

Deed June, 1838 - Benjamin DeSpain and wife, Edith, to William DeSpain ....$300 ....tract on Alex Fork of Pitman Creek ....bank of fork of Pitman Creek ....mouth of DeSpain's mill race ...125 acres.
Wit: Harvey, Jinning, Elijah Davidson,. Warren Co, IL: James Turall and Gilbert Turnbull, JP states they know Benjamin and Edith DeSpain and acknowledge the deed.

Benjamin moved to IL in 1834. He is in Warren Co, IL in 1840 and 1850 census. Jeremiah Despain's biography stated that the family arrived in Lane Co, OR in 1852. Actually Jeremiah and Benjamin Jr. went to OR in 1852 and returned to IL. Benjamin with his 4 youngest sons went to OR in 1854. Benjamin was a "Joseph Smith" Mormon and he possibly left IL because of all the trouble at Nauvee.

Benjmain had Donation Land Claim #1115 taken out in ! Dec 1854 and signed by William R. Jones. He arrived OR 7 Aug 1854. Benjamin and his 4 sons bought about 1850 acres of farm land in Lane County and 4 1/2 city block of early downtown Eugene. They ran the first Oregon stage coach line and a livery business.. They owned an Inn and a stable.

        Note:
        It is not known if Scotty & Sally married before or after the move to southern Montgomery Co, VA near the North Caroline boarder. There are several male Petersons listed in Daniel Trigg's Company of Montgomery County, 31 Mar 1781. They may be her family.

        In the Circuit Court Case # 3977 papers, it is stated that Susan died a few days after James. Therefore she probably died just before 20 Jan 1835. Her surname is from W. W. Whitaker's files. However there does not seem to be any written proof of her name. It supposedly comes from one of her grandson being named, John Peterson DeSpain. Mr. Whitaker also mentions another grandson named James Peterson Despain.
