The son of Jeremiah Foley [probably son of Luke and Mary Foley] and Jeremiah's wife Barbara Foley Jr., daughter of Bartholomew and Barbara Foley.
Jeremiah Sr.'s name was given by James' widow Judith in 1859 on James' death record in Mercer Co., WV. She was well enough acquainted with James' family not to have confused his brother Jeremiah Jr. with his father.
There has been a great deal of confusion regarding the identity of James's parents as his mother, Barbara Foley Jr., married her cousin and then was widowed while her mother, Barbara Foley Sr., was still living, resulting in there being two Mrs. Barbara Foleys in the neighborhood at the same time. However, the children of both Barbara's are named in various probate papers and Barbara Sr. died by 1829 (probably much earlier), while Barbara Jr. died in 1833 or 1834. His grandmother was usually referred to in legal papers as Barbara Foley Senior to distinguish her from her daughter.
He married 12 Sep 1817, Stokes Co., NC, to Judith Thomas. They actually lived across the state line in Patrick Co., VA, but it must have been more convenient to get to the Stokes county court house. She was the daughter of Richard and Elizabeth (Ferrell) Thomas.
By 1820, they had two children and were living near James' family:

26 Oct 1822, James bought 50 acres on Sycamore Creek from his mother for one dollar. Patrick Co. deed book 6, p. 186.
James' mother Barbara died in 1834.
18 Aug 1835 - Patrick Co., VA deed book 9, p. 84. Richard Thomas sold James Foley 133 acres on east side of Sycamore Creek.
John and Sally's great-great-granddaughter, Billie (Sneed) Leighter many years later made a trip back with her own daughter Nancy to explore the area and try and seek out the family history. They found a very steep, hilly, wooded country unsuited for agriculture, with only enough arable land along the creek beds to perhaps put in a vegetable garden and run a cow or two. There were few people left there who remembered much of the early history of the neighborhood, but Patrick County had remained a part of the frontier until long after the Revolutionary War. There were a few prosperous families there in the early 1800's, but most struggled just to scrape by and feed their children. There were few cultural amenities, all of the towns were mere villages, and the county courthouse itself was so ill-supplied that for more than fifty years the criminal records of the county were kept scrawled on the walls of the two jury rooms. (They were unfortunately lost when the rooms were finally given a new, badly needed coat of paint.) But even those few records weren't even begun until 1875, after James and Judith had left Virginia.
In 1850, James and Judith had a good amount of land. Their next door neighbors on one side were their daughter Sally's parents-in-law, Samuel and Esther (Turner) Sneed. On their other side lived their son Richard and his wife and daughter.

On October 12, 1853, James and Judith and their sons Richard and Charles all sold their land in Patrick County and moved a little further west to Mercer Co., WV, now just across the line from Virginia. Son Richard's daughter Minerva was born there in January 1854. Their daughter Sally Sneed and her family also made the move, either at the same time or perhaps a few years later after her father-in-law died in Patrick County.
James died in Mercer Co., WV on 12 May 1859 and was buried on the old Foley farm (the Foley family cemetery).

18 Aug 1843, Patrick Co., VA - Richard was on a jury that convicted the defendant and fined him one penny. They must have thought he was justified in whatever it was he was accused of.

"151ST VIRGINIA MILITIA, CO. F
This unit was organized by Richard B. Foley of Flat Top in August 1861 in Mercer County of what is now West Virginia. This Home Guard unit also known as Co. F of the 151st Confederate Virginia Militia, scouted for the Confederate States Army and participated in the Battle of Clark House, Mercer County, on May 1, 1862, in which Captain Foley was wounded in the shoulder. This wound never healed properly and eventually was the cause of his death.
The Confederate force in that battle was led by Major Henry Fitzhugh. The Federal forces were part of General Jacob B. Cox Ohio command. In the Federal forces Lt. Col. Rutherford B. Hayes (the future 19th President of the United States, 1877-1881) was commanding.
When reorganized in March 1862 the men of Captain Foley took this oath:
"We, the undersigned do hereby constitute ourselves into a company of guerrillas, known by the name of Flattop Copperheads, for the purpose of defending our immediate country, and western Va., against the invasion of the Yankeys (sic). We bind our selves by every obligation of honor and paternage, to obey the command of our officers, and be true and faithful to the Confederate States of America, and to be true to our selves and families, and serve for the during term of six months except sooner discharged. March 28th 1862."
Before the Clark House battle the Flat Top
Copperheads were hidden in the forest at Camp Creek and protected by darkness they before sunup converged with other companies on the Clark House, where Yankees under Lt. Botsford of the 23rd Ohio had barricaded themselves. His force was part of a Yankee regiment originally stationed in Raleigh County, but now on the offensive. After some fighting the Confederates gained the upper hand and were preparing to storm when Yankee reinforcements appeared led by Lt. Col. Hayes and opened fire. The Confederates had to retreat.
Captain Richard B. Foley was born in Patrick County, Virginia, in 1818. In 1848 he married Parshandatha McAlexander and they had ten children. The family moved to Flat Top, Mercer County, where they had purchased land. After the WBTS Foley was Mercer County Clerk from 1873 to 1879. He died in 1882 and is buried on his home place on Flat Top Mountain. A military marker was erected in 1988.
Information on this little known Confederate unit for protection of home and land (designating themselves guerrillas) has been provided by 1st Lt. Commander Richard D. Lockhart of SCV "Flat Top Copperheads" Camp # 1694, who is related to Captain Foley via his daughter."
1862 - Richard was received a bullet wound in his shoulder during a battle with Union troops. This wound never completely healed:
"On April 30, 1862, Capt. Botsford with a group of men including Capt. French, was sent from Camp Jones to look for Capt. Foley's men, and any advance of the Confederates from Princeton. They spent all day searching for Foley's men, but didn't find them. They even visited Foley's home.
That day Foley's men had divided into Groups and kept themselves concealed, but at the same time were watching every movement of Capt. French and the Union soldiers. Late in the evening Capt. Botsford and his men went into camp in the home of Henry Clark, between Flat Top and Camp Creek.
As soon as Foley saw they intended to spend the night, he sent a man to Col. Jennefer asking for men to help. In the meantime, they his behind trees and bushes on a hill overlooking the front of the house.
Day Light came and no help was in sight. The Union men began to come out of the house and line up for roll call, not suspecting any danger.
Foley knew the moment had come to strike at the company of Union men. In the early dawn of May 1, he gave the command to his men to fire. The men fired almost simultaneously into the Union soldiers.
Sgt. White was killed and a number wounded before they made a dash for the door and rear of the house. They got inside and returned fire through the holes they made between the logs in the walls.
The Battle lasted for about one-half hour, then reinforcements came from Princeton, and it looked like a victory for the Confederates. But soon they saw the Union soldiers coming about a quarter mile away. As far as they could see there were soldiers, and seemingly on end to them.
The Confederates withdrew in the direction of Princeton. Foley and his men went into the forests around Camp Creek. Some of the Confederate men were killed, and other wounded including Capt. Foley. He received a shoulder wound that never healed.
One union man was killed aand at least 19 wounded. French had a leg wound and was a cripple for life. It seemed a twist of fate that he was wounded by one of Foley's men.
He and some of his neighbors never completely got over the war. Some would refer to him as a Yankee pensioner, and sometimes use other terms, ot as polite. In later years French and Foley met, embraced each other, and wept.
All were valiant men and good citizens fighting for what they thought was right. Some of Foley's grandchildren and great-grandchildren have been good neighbors of French's grand- children and great-grandchildren at Flat Top for several years."
