Sen. Feinstein: Treating Bombing Suspect as an Enemy Combatant Would Be ‘Unconstitutional’
On Fox News Sunday, chairwoman of the Senate Intelligence Committee, Senator Dianne Feinstein (D-CA) said she “believes very strongly” that the Boston bombing suspect should be read his Miranda rights and given a lawyer.
“I think that’s the only legal way to proceed. I do not believe under the military commission law that he is eligible for that (enemy combatant status). It would be unconstitutional to do that,” Sen. Feinstein said.
Police did not read Dzhokhar Tsarnaev his Miranda rights under the public safety exception. Tsarnaev has been unable to speak with the FBI due to a gunshot wound to his throat. They have 48 hours until he must be read his rights, unless they decide to charge him as an enemy combatant.
Rep. Peter King (R-NY) and other Republican lawmakers are pushing for the Obama administration to charge him has an enemy combatant. King cited “the purpose of interrogation” as his reason on Fox News Sunday. “There are so many questions unanswered; there are so many potential links to terrorism here. Also, the battlefield is now in the United States.”
